Sales Agreement 

 

 Health Guarantee

 

All puppies are healthy to the best of the seller's knowledge. The buyer has 72 hours (excluding Sundays if purchased on a weekend) from the time the puppy leaves the seller's premises to have it checked by a licensed veterinarian at his or her own expense. If the veterinarian determines the puppy to have a life-threatening genetic defect, the buyer may return the puppy within 48 hours (at his or her own expense) to be examined by our veterinarian. If our veterinarian agrees with the diagnosis, the seller will exchange the puppy for one of comparable value when one becomes available. If the buyer does not have the puppy checked within this time frame, all guarantees in this contract are considered to be null and void. 

All dogs are current on their age appropriate vaccinations. If a puppy has not finished its 3 shot series and the buyer brings the puppy out in public or in contact with other animals or people with diseases and illnesses, the seller assumes no responsibility if a puppy contracts any illnesses including but not limited to Parvo, Canine Distemper, Para influenza, Adenovirus, hepatitis, ect. The seller will not be responsible for replacing the ill puppy or for any vet fees. The buyer must realize that exposing a puppy younger than 6 months of age to unknown environments, animals, and people may cause illness or death.

The seller does not guarantee the puppy against Bordetella/Kennel Cough. All puppies have been given the Bordetella vaccine as shown in the health record to avoid kennel cough. The vaccine does cover the most basic strain of Bordetella but does not cover all strains. The buyer must realize that puppies have developing immune systems and are very susceptible to illnesses. If a puppy comes in contact with another dog that has kennel cough the puppy may still contract the illness. The seller will not be responsible for any vet fees resulting from illness including medications.   

The seller does not guarantee the puppy is free from worms. This puppy has been wormed on the dates shown in the health record. This health guarantee does not cover parasites of any kind, internal or external (including coccidia, giardia and/or mites, fleas). Many puppies are prone to outbreaks of either Coccidia and/or Giardia under stressful circumstances.  The symptoms can arise in a 12 hour period and can not always be prevented by the seller, because there are no signs until the puppy is stressed and their immune system drops. All precautions have been made, but the buyer should take the puppy to the vet immediately if the puppy develops an unusual stool, begins vomiting or has loss of appetite. The seller will not be responsible for any of the buyer's expenses, including veterinary bills for this puppy or any other associated animals.

This sales agreement does not cover Hypoglycemia/low blood sugar. It is the responsibility of the buyer to make sure the puppy is eating, drinking, kept warm and is getting plenty of rest on a regular basis.  The buyer agrees not to hold the seller responsible in the case that the puppy develops hypoglycemia. The buyer should take the puppy to the vet immediately if the puppy exhibits symptoms of Hypoglycemia, failure to do so may result in death. 

 

The puppy is guaranteed against any life-threatening, genetic defects for a period of 1 year of purchase. This does not include patellar luxation, cherry eye, molera (This is acceptable for the chihuahua and should not be considered a flaw), collapse of tracheal rings, hernias, or non-descending testicles. If a defect is found within one year of the issued sales agreement date, the buyer must notify the seller as soon as possible and provide the seller with a signed vet statement. The buyer must return the puppy to the seller within 7 days (at the buyer's expense) to have it examined by the seller's veterinarian to confirm the diagnosis.  If the seller's veterinarian agrees with the diagnosis, the seller will replace the puppy with a comparable puppy when one becomes available. The seller will assume no responsibility for any of the buyer's expenses, including veterinary bills and/or shipping of the new puppy. The buyer assumes full responsibility for the health, appearance, and temperament of the puppy until it is returned. Failure to do so forfeits your right to a new puppy.

No Cash Refunds will be issued. If the buyer chooses to keep the puppy, the buyer assumes all responsibility for the care of the said puppy including vet expenses. The seller can then choose to give the buyer a discount on another puppy (depending on the severity of the defect), but is not obligated to do so, if the buyer chooses to keep the said puppy. 

 

If for any reason a puppy becomes deceased in the buyers care a veterinary report must be sent to the seller stating definite cause of death. A replacement puppy will not be provided unless a licensed veterinarian states definite cause of death caused by a genetic defect.  In some cases a necropsy must be done. All veterinary expenses are the responsibility of the buyer. If a formal report from the veterinarian is not supplied to the seller the seller has no proof of death or cause of death and is not obligated to replace the deceased puppy.  

 

Deposits and Shipping

 

A $300.00 to $500.00 deposit is required to hold a puppy until it is ready to leave the seller's premises. Deposits are non-refundable and non-transferable, so please be sure about the puppy you want to purchase. In the event the puppy becomes deceased in our care, deposits and or payments will be transferred to another puppy of equal value when one becomes available.

Shipping to major airports is available with a pet nanny for an additional cost of $525.00. Puppies must be at least 12 weeks old to ship, but in some cases possibly older due to size. Puppies should weigh close to 2lbs. before shipping.  Socialization at an early age is important, and all of our puppies are socialized with lots of adults, older children, and other Chihuahuas.

Cash, postal money orders, PayPal and Walmart money gram are accepted for deposits, shipping costs, and final payments, some with time constraints. No personal checks please. Puppies will not be shipped until all payments have been received. All puppies will be vet-checked before being shipped.The seller assumes no responsibility for injury, illness, death, or loss of puppy during or after transport to the buyer's home. The buyer must understand that shipping can be very stressful for a puppy, and illness can occur due to stress. The buyer assumes all responsibility once the puppy has left the seller's care.

The seller is not responsible for any fees regarding transportation of the puppy.  This includes shipping by airplane and gas for driving.  If a puppy must be brought back for any reason the buyer is responsible for the transportation.  It is not the responsibility of the seller to retrieve the puppy or meet part of the way. The buyer must make arrangements for the puppy to be brought back to the seller.

 

 Registration 

 

This puppy is being sold strictly as a pet! Registration is not included in the price of the puppy. All puppies are sold as pets unless prior arrangements have been made for full or limited AKC registration. If prior arrangements are made, the buyer will receive registration papers along with the puppy if possible, however, if the registration is pending, the papers will be mailed as soon as they become available. This could take up to 90 days. It is the buyer's responsibility to transfer the registration, and this includes any and all fees associated with registration. If full registration is given breeding ability is not guaranteed. If the puppy is registered and all of the paperwork has been transferred to the buyer, it is then the responsibility of the buyer to have all transfers signed if the puppy is being returned.

    

Miscellaneous

 

If the buyer does not pick up the puppy or accept delivery within two weeks of the agreed upon date, the seller has the right to keep the deposit, any payments made towards the sales price, and/or the shipping, and resell the puppy. If the buyer takes possession of the puppy after the two weeks, any additional veterinary bills (shots) or care expenses will be added to the final purchase price of the puppy and must be paid before the puppy will be released to the buyer.

 

 

 Refund Policy 

 

Please be sure you have done your homework on the Chihuahua breed and how to care for chihuahua puppies. Please be sure that all family members and pets will be okay with the new chihuahua puppy. Buyers remorse or difficulty potty training is not an acceptable reason for a return. If the buyer is not able to keep the purchased puppy, the buyer has one week to return the puppy for a partial refund. A $500 non-refundable charge will apply.  Before any refund is given to the buyer, the seller must first have possession of the said puppy and the seller's veterinarian must verify that the puppy is in good health.  ONLY then will a refund apply minus the $500 non-refundable charge.  If the buyer is no longer able to keep the said puppy after one week, no refund what so ever will be given.

This puppy is not guaranteed to be potty trained.  All of my puppies are started on Potty Pad Training at 6 weeks of age, so they have a good start to potty pad training.  The buyer must understand that when put in a new environment a puppy must be retrained. The buyer assumes all responsibility for house training their new puppy.

 

 

The buyer assumes all responsibility for appropriate care of their puppy. Small puppies and dogs should be watched closely in the presence of small children. Chihuahuas can easily be injured by falling from couches, being stepped on, and being closed in doors. Chihuahua puppies are also susceptible to hypoglycemia. The buyer needs to understand the seller will not be responsible for any injuries to the puppy in the buyer's care. Even though we strive to produce the best quality puppies possible, we make no guarantees regarding size, color, disposition, show quality, or breeding ability. We may estimate the adult weight of a puppy based upon a published Chihuahua weight chart; however, there are no guarantees that the puppy will end up at the estimated weight due to influences beyond the seller's control.

If the buyer does not fulfill all terms of this agreement, all rights of the buyer will be forfeited. 

 

By paying the deposit and or paying the puppy in full, the buyer acknowledges agreement to all of the terms of this contract.

First Come, First Serve Policy:   I will not hold a puppy without a deposit.  Please do not ask me to reserve a puppy for you without a commitment to buy.  The only way I know that you will honor your commitment to buy the puppy is by putting down a deposit.
